Appellate Division Decisions

  • Matter of Meyer v Nassau County Police Dept., 2025 NY Slip Op 00660 (2nd Dept. 2025) In a case where Petitioner sought information relating to various motor vehicle accidents, the Second Department reversed the findings of the trial court and remanded the matter to be determined on the merits of the Petition .

  • Sethi v. Town of Hempstead, 2024 N.Y. Slip Op. 6202, (N.Y. App. Div. 2024) The Second Department affirmed the determination of the trial court, which awarded $60,015 for attorneys fees pursuant to FOIL’s fee shifting provision.

  • Lane v. Nassau County Police Department, 2021-04608 (2nd Dept. 2023)In a case where our client, a journalist, sought a department telephone directory, the Appellate Division reversed the lower Supreme Court and directed the NCPD to produce the directory in unredacted form, noting that the purported public availability of said directory does not abrogate the agency’s obligation under FOIL. The Court also remanded for an assessment of costs and attorney’s fees in accordance with FOIL’s mandatory fee shifting provision. 

  • Aron Law v. City of Rochester, NY Slip Op 03979  (4th Dept. 2023)In a case where our client sought information relating to requests for disability accommodations and religious observances by City of Rochester employees, the Appellate Division reversed the trial Court and held that the request was "reasonably described" and remand for a diligent search and production of responsive documents.

  • Jewish Press v. NYPD, 190 AD3d 490 (1st Dept. 2021)

In a case where our client sought information relating to records held by the NYPD in relation to a pending traffic court proceeding, the Appellate Division reversed the lower Supreme Court and held that the NYPD failed to meet its burden under the "law enforcement/interference" exemption, to justify a “blanket denial".

  • Aron Law v. New York City Fire Department, 191 AD3d 664 (2nd Dept. 2021)

 In a case where Petitioner sought information relating to the RO and EEO complaints from the New York City Fire Department, the Appellate Division reversed the lower Supreme Court and held that, among other things, where documents can be redacted to protect the complainant's identity, those documents must be redacted and turned over.

  • Jewish Press v. New York City Department of Investigation, 193 AD3d 461 (1st Dept. 2021)

In a case where our client sought information relating to a certain investigation conducted by the NYC Department of Investigation, the Appellate Division reversed the lower Supreme Court and held that the agency’s investigation concluded before the FOIL request was made, and therefore records must be turned over.

  • Jewish Press v. NYC Dept. of Education, 183 AD3d 731 (2nd Dept. 2020)

In a case where our client sought information relating to instances where the Department of Education had denied absences for religious observances, the Appellate Division reversed the lower Supreme Court and held that the requirement that a request be "reasonably described", should not be conflated with the burden necessary to retrieve the requested documents.

  • Aron Law v. Town of Fallsburg, 199 AD3d 1286 (3rd Dept. 2021)

In a case where Petitioner sought information relating to property tax grievances from the Town of Fallsburg, the Appellate Division reversed the lower Supreme Court and held that Petitioner was entitled to reasonable costs and legal fees pursuant to FOIL's mandatory fee shifting provision.

• 155280/2019 - THE JEWISH PRESS INC. v. NEW YORK CITY POLICE DEPARTMENT -

The court granted Petitioner’s application to hold the NYPD in contempt for failure to comply with prior court Order directing the production of various documents

• 612665/2021- LAW OFFICES OF JASON J. REBHUN, P.C., v. VILLAGE OF CEDARHURST -

The Proceeding successfully resulted in the village conducting a diligent search related to maintenance records of one of its parking lots

  • 153580/2021 - M Safety v NYPD-

Successfully resolved Petitioner's request for costs and and attorneys fee's in accordance with FOIL's fee shifting provision.

  • 154811/2020 - The Forward Association v NYPD-

The New York County Supreme Court directed the NYPD to produce records relating to bias incidents. Those records included redacted versions of complaint reports, unusual occurrence reports and closing reports  associated with sealed files. The Court also granted our application for costs and attorney's fees pursuant to FOIL's fee shifting provision.

Petitioner successfully obtained nearly a thousand documents associated with the covid mandatefor city employees

• 606699/2022- HOLCZER LAW FIRM, PLLC. v. VILLAGE OF CEDARHURST -

The Proceeding successfully resulted in the village conducting a diligent search for maintenance records of one of its sidewalks

  • 159239/2020 - The Forward Association v New York City Police Department-

The Proceeding resulted in the "voluntary" production of documents sought by the Petitioner. 

• 155395/2022 - THE JEWISH PRESS INC. v. NEW YORK CITY POLICE DEPARTMENT -

Petitioner successfully obtained records associated with anti semetic hate crime attacks

  •  152905/2022-   Aron Law - v. - New York City Health and Hospitals Corporation -

The New York County Supreme Court granted our Petition to compel HHC to produce unredacted reports from multiple consulting firms related to the 2017 managerial layoffs, in its entirety. The Court also granted our application for costs and attorney's fees pursuant to FOIL's fee shifting provision.
